Good news for Pennsylvania gun owners who wish to become a medical marijuana patient. Governor Tom Wolf stated that the state police and law enforcement will not seek out patients who possess firearms. It is suggested that if you plan to become a patient and own a firearm that you seek advice from your attorney on the subject. Please keep in mind that purchasing a firearm as a patient is technically a violation of federal law. On the form that must be completed to purchase a firearm (federal form) a question asks if the purchaser is “An unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug or controlled substance?”. It has been updated with a warning that says, “the use or possession of marijuana remains unlawful under federal law regardless of wether it has been legalized or decriminalized for medicinal purposes or recreational purposes in the state where you reside”.
